Amar Chitra Katha Pvt. Ltd. (“Company”) is organizing a club titled as - “Tinkle Young  Adventurers’ Club” (“Club”).

The Club is to be created by Amar Chitra Katha Pvt. Ltd. having its registered office at 204, 2nd Floor, Dhantak Plaza, situated at Makwana Road, Gamdevi, Marol, Andheri East, Mumbai, Maharashtra – 400 059.

The Club Trip will be on 30th July and 6th august and shall be conducting 1(one) day nature trips for children and their parents/guardian as a part of this Club’s activity
(“Trip(s)”). The Trip(s) shall be organized solely by the Company and children accompanied by their parent and/or guardian can participate in such Trip(s) of the Club.

The Trip(s) shall be open to all children between 7 to 14 years of age, entering through their parent and/or guardian and who are residents of India (“Participant(s)”).

The Company shall commence accepting applications for the Trips from 15th July 2022 and shall close the applications on 28th July 2022. Selection of the participants for the Trip(s) shall be on a ‘first come first serve’ basis.

It shall be mandatory for 1 (one) parent/guardian to accompany their child on the Trip(s).

By applying for this Trip(s), the Participant(s) is indicating his/her agreement to be bound by these terms and conditions for the Club and Trip as mentioned by the Company under this Terms & Conditions.

To apply for being a part of this Club and come on Trip(s), the Participant shall be required to register the details fill out a form as provided by the Company and paid fees in advance.

The fees for the Trip(s) shall be paid by the Participant(s) in full and advance booking shall be required to be done by the Participant(s).

The Company shall start accepting applications for this trip from 15th July and each batch shall have approximately 15-17 Participant(s). 

The parent/guardian shall be solely responsible for their child’s security and safety.

The Participant(s) shall be solely responsible for timely arrival to the Trip(s) destination 

and the no transportation means shall be provided by the Company. The Company shall initiate the Trips and its itinerary on time and as scheduled.  

Each Participant(s) shall be given the Trip’s itinerary and food shall be provided by the Company. 

In the event, any of the Participant(s) is allergic to any particular food and/or food group, the parent/guardian shall be responsible for making the Company aware about such allergies.

The Participant(s) shall be given a choice and shall be responsible for selecting the food preference (vegetarian or jain option) in application form provided by the Company. The company shall not provide any non-vegetarian option for food for such Trips. 

The selection of Participant(s) for this Club and Trip(s) along with any changes to it shall be at the sole discretion of the Company. 

All confidential information including without limitation all intellectual property rights shall remain the property of the Company and no license or other rights to use shall be granted to any Participant(s). 

The Participant agrees that all rights associated with this Club and Trip(s) shall vest with the Company at all times. The Company shall retain all rights, titles and interest in its patents, copyrights, trademarks, trade name, trade dress, service marks and trade secrets and/or creations, model, data, flow chart, drawing, design, diagram, table, artwork, innovation or any other information or material ("Intellectual Property Rights") in perpetuity. In the event it is claimed that any part of the application or answers submitted by the Participant infringes any person’s copyright, the Participant agrees to indemnify against all costs, expenses, losses, fines etc. incurred, borne or suffered by the Company. 

The Company reserves the right to, without liability or prejudice to any of its other rights, at any time, without previous notice and from time to time, withdraw/suspend/amend/cancel this Club and Trip(s), with or without any reason.

The Company on its own discretion shall give the Club and Trip(s) members prizes, subscriptions, badges, certificate, etc. or anything else for becoming a part of the trip. The decision of the Company in all matters regarding the Club and Trip(s) shall be final and binding. 

Nothing under these Terms and Conditions shall mean the transfer of any rights, including but not limited to, Intellectual Property Rights by the Company to the Participant(s).

The rules for the Club and Trip(s) shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Club and Trip(s) are subject to the jurisdiction of the courts at Mumbai only.

The Company shall be in no way obligated to complete a tour if one or more Participant(s) shall be found to be endangering the safety of themselves, others or the environment. Refunds will not be given in such situation.During the Trip(s), the Participants shall abide by the instructions and decisions of the Trip Director or authorised representatives of the Company. 

During the Trip(s), in case of any dispute for whatsoever reasons, the decision of the Trip Director or authorised representative of the Company shall be final and binding on all the Participant(s). In the event the Participant(s) disobey the directions / instructions of the Trip Director or authorised representative of the Company, the Participant(s) shall be solely liable for the risks, responsibilities and consequences.  

The Company reserves the right to alter the Trip(s) i.e. scheduled activities due to bad weather or any other unforeseen circumstances which are beyond our control. Such a decision will be binding and acceptable to all.

The Company reserves the sole right to re-schedule and/or cancel the Trip(s) due to any unforeseen circumstances, weather conditions and/or medical emergency.

In case of any injury, sickness, accident or any other casualty or loss or damage of valuables or luggage or any equipment caused, if required, the Participant(s) shall have to take medical treatment from the doctor/ attendant available on the Trip(s) site or from the nearest available medical centre or hospital. The expenses for all medical treatment and arrangements for the same will be solely borne by the Participant(s). The Trip Director or the authorised representative shall have complete discretion to continue the Trip(s) without the Participant(s) suffering from medical problem.

Consumption and/or possession of liquor, tobacco products, cigarette, Narcotic substances etc. is strictly prohibited on Trips organised by the Company.

Cancellation and Refund Policy: Cancellation is allowed one week prior to the Trip(s). No refund shall be given in case of cancellation post one week prior to the Trip(s).

The Company’s decision in respect of all matters to do with the Club and Trip(s) shall be final and no correspondence shall be entertained.

Nothing contained in these terms and conditions, nor the running of this Club and Trip(s) to which the Participant(s) apply, shall be construed as an obligation on the Company.
